What kind of data do we gather?

When you utilize our services, you accept our company gathering some of your data. This page tells you which specific data we collect, why, and how we use them.

We treat two kinds of data:

Data purposely granted by the user

You can navigate our website without giving any data.

By contacting us through a contact form, you’d have to give us your name, surname, phone number, and email address.

Subscribing to our newsletter will never entail giving us your phone number.

Third party data

By giving us data belonging to third parties, such as family members or friends, you must be assured that these people are sufficiently informed and have agreed to the relative treatment in the modes described on the current page.

Data of people being less than 16

By being less than 16, you legally are not allowed to give us any data nor subscribe to our newsletter. We, “Luxer,” do not take responsibility for any mendacious statements given to us. If we notice the existence of untruthful statements, we’ll proceed with the immediate cancellation of any data acquired.

Data collected automatically

We collect the following data through our services:

– Technical data: Such as your IP address, what kind of browser you use, data related to your device, data related to the (estimated) current geographical position of the device you’re using;
– Data collected through cookies or similar: we suggest reading the “Cookies” section for more info.

1. How do we use the collected data?

We use data to offer you our service, to inform you of our commercial activities, or to suggest a more customized service in line with your interests.

1.1. Inform yourself about our commercial activities

If you explicitly consent to us, we will use your data to inform you about promotional activities that might interest you.

We especially use them to:

communicate promotional, commercial, and advertisement activities regarding events and initiatives through email, SMS, or push notification;

construct analyses and reports connected to the promotional communication systems, such as gathering the number of opened emails, of clicks made on links inside the communication, of the kind of device that’s being used to read it and the relative operating system, or those who unsubscribed from the newsletter.

These treatments are based on the legitimate interest of the Owner (read 3.1), which you can oppose at any time.

1.2. To offer you a customized service

If you explicitly consent to us, we elaborate the collected data to analyze your habits or usage choices, to provide you with a customized service consistent with your interests, and to improve our commercial offer. These analyses are not linked to any automated processes.

2. Is giving us your data mandatory?

Giving us your data is entirely optional, as it only influences advertisement and tracing. The eventual refusal does not have negative consequences while navigating our website.

3.1. The Owner of the service

The Owner of the service does not make use of individuals to achieve the purposes present in point 1 and of a Data Protection Officer (DPO) as it doesn’t belong to any of the categories listed in point 3.2 to safeguard data.

3.2. Data Protection Officer (DPO) and contact information

Nominating a DPO, in accordance with article 37, paragraph 1, of the GDPR, is mandatory in three cases:

  1. if the data management is carried out by a public authority or a public organization.
  2. when the organization’s main activities consist of services that require a “methodical and periodic monitoring” of “large scale” interests.
  3. when the organization’s main activities consist of “large scale” services managing “sensitive data” (rectius, “particular kind of data”) or “legal data” (rectius, “data related to sentences and crimes”).-
3.3. Parties we could communicate your data with

Data gathered during the supply of our service could be communicated to:

companies that carry out jobs strictly connected to the functioning – even technical – of our website, for example, providers, whose services are connected with direct marketing or customer care, and organizations whose administrative and giudical autorities by law’s power.

We will never lend or sell your data to third parties.

4. How can you consult, edit, delete, or copy your data?
4.1. Accessing Mailchimp data and revoking consent (opt-out)

You can check the data gathered by Mailchimp and the external company that manages the newsletter at any time through the link noted in all received newsletters.

You may revoke the consent you’ve previously given at any time.

4.2. Data export and cancellation

To export your data (takeout) or demand their cancellation, you may forward a request to info@luxerincoming.com from the email address typed in the contact form.

Your data will be exported within 30-90 days, depending on how complex the process will be.

The cancellation will be completed in the required time and according to the storage period in point 5.

4.3. Exercise of your rights

Every natural person subscribed to our service may:

  • Request from the owner, at any time, information regarding the existence of their data, its origins, purpose and circumstances of the service, and, if the data exists, to obtain access to said data and the information regarding article 15 of GDPR;
  • Request the update, correction, integration, deletion, and limitation of the data service if one of the circumstances present in article 18 of GDPR, the conversion in anonymous data, or the block of the data, due to breaching the law, occurs. This is also valid for data for which storage does not need to be kept concerning the purposes for which the data were collected and/or subsequently processed;
  • Oppose, totally or partially, and for legitimate reasons, the processing of the data, even applicable to the collection and managing of said data established for commercial information, forwarded as advertisement material, or direct sales, meaning completing market research or commercial communication. Every user has the right to revoke the consent at any given moment without compromising the lawfulness of the service, based on the consent granted before the revocation;
  • Receive their data, provided knowingly and personally, or throughout the usage of the service, in a structured format, of ordinary use and compatible with an automatic device, and able to send it to another service owner without obstacles;
  • Forward a complaint regarding your data protection to the Italian Guaranteeing Authority.

5. In what way and how long will your data be stored?

Data storage can happen in two ways: on paper and/or on a computer and only for the necessary time to fulfill the purpose of the service stated in point 1, respecting your privacy and the applicable laws.

The user’s data could be prone to the same storage period related to direct development analyses and service improvement.

In case the user were to exercise his right to be forgotten through a cancellation request expressed with the data managed by the owner, we want to remind you that said data will be stored under protection and in limited access only for scrutiny and suppression of crimes for a period of a maximum of 12 months from the request date. After that, the data will be safely and anonymously deleted without the possibility of recovering it.

We remind you that for the same purposes, data related to Internet traffic, besides the actual content of the communications, will be stored for a maximum of 6 years from the request date, according to article 24 of law n. 167/2016, adopting Directive EU 2017/541 on the subject of antiterrorism.

If you don’t carry out any active action (such as browsing, searches, and/or any other way of using our services) on our website for more than 27 months, you will be classified as an inactive user, and your data will be automatically deleted.

6. How do we guarantee the protection of your data?

Following the directives of the related regulations, the collected data listed under point 3, with particular attention to the safety measures within GDPR (art. 32), is treated through IT devices, manuals, and automated with logics strictly tied to the purposes of point 1, and ensuring the safety of the collected data.

Following the applicable law, an anti-spam system is applied between users. Data communicated this way will only be able to be verified for detecting illegal activites or contents which are not related to the generality of the Service, but will never be treated or forwarded for commercial or advertisement purposes.

The contact form functions are a way of communication between our company and the users who visit the website and can be used exclusively as a form of information based on the requests of the users.

Data inputted in the form will be used by our company exclusively to fulfill the requests forwarded in the form.

7.2. Position

When you browse our website, we collect and elaborate data relative to your (estimated) current geographical position. These data will be processed anonymously in a format that does not allow to completely identify the user they originate from. Moreover, these data are only used to ease some of our services based on geographical position.

8. Is the Privacy Policy subject to changes?

Qualora vengano apportate sostanziali modifiche all’utilizzo dei dati relativi all’utente da parte del Titolare, quest’ultimo avviserà l’utente pubblicandole con la massima evidenza sulle proprie pagine o tramite mezzi alternativi o similari.
